Terms of Service

These Terms of Service ("Terms") govern your use of the Facelytics web application (the "Service") operated by BCL Trading LLC, a Missouri limited liability company ("Company," "we," "our," or "us").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you are prohibited from using this Service.

3. Description of Service

Our Service provides AI-powered facial attractiveness analysis using computer vision and machine learning algorithms. The Service:

• Analyzes uploaded photos for facial features and attractiveness
• Provides attractiveness ratings on a 1-10 scale with percentile rankings
• Offers Best Photo comparison feature for premium users (up to 3 photos)
• Provides usage tracking and subscription management for premium accounts
• Enforces rate limits (2 free ratings per week, 50 premium ratings per month)

Subscription Tiers

• Free Tier: 2 face ratings per week with basic analysis
• Premium Tier: 50 ratings per month with Best Photo comparison feature

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload images of other people without their explicit consent
• Upload images of minors (under 18 years old)
• Upload inappropriate, offensive, or illegal content
• Use the Service to harass, bully, or harm others
• Attempt to reverse engineer or extract our algorithms
• Use automated tools to access the Service excessively
• Upload images that violate copyright or other intellectual property rights
• Use the Service for commercial purposes without authorization

5. Content and Uploads

• Your Responsibility: You are solely responsible for all images you upload
• Consent Required: You must have permission to upload and analyze any image
• In-Memory Processing Only: Images are processed entirely in memory and never stored to disk
• Immediate Deletion: All image data is deleted from memory immediately after processing
• Best Photo Feature: Multiple images may be processed simultaneously for comparison
• Processing Rights: By uploading, you grant us the right to process images for analysis
• Privacy-First Design: No image data is logged, cached, or retained

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Disclaimers and Limitations

Service Disclaimers

• Entertainment Only: Our ratings are for entertainment purposes and should not be considered professional advice
• Subjective Nature: Attractiveness is subjective; our AI provides one algorithmic perspective
• No Guarantees: We make no guarantees about accuracy, reliability, or completeness
• Technical Limitations: Face detection may fail on certain images

Important: This Service is not intended to provide medical, psychological, or therapeutic advice. If you experience negative self-image or mental health concerns, please consult qualified professionals.

8. Intellectual Property

• The Service, including algorithms, design, and content, is owned by BCL Trading LLC
• You retain ownership of images you upload
• You may not copy, reproduce, or distribute our algorithms or proprietary technology
• Our trademarks and logos are protected intellectual property

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• BCL Trading LLC shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid by you for the Service (if any)
• We are not responsible for how you or others use or interpret the ratings
• We are not liable for technical failures, interruptions, or data loss

10. Indemnification

You agree to indemnify and hold harmless BCL Trading LLC from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or submit

11. Service Availability and Payment Terms

Service Availability

• We strive to maintain Service availability but cannot guarantee uninterrupted access
• We may modify, suspend, or discontinue the Service at any time
• Usage limits are enforced automatically (2 free/week, 50 premium/month)
• Scheduled maintenance may temporarily interrupt Service

Premium Subscriptions

• Payment Processing: All payments are processed securely through Stripe
• Email Verification: Premium access requires email verification
• Monthly Billing: Premium subscriptions are billed monthly
• Usage Tracking: Premium usage is tracked and displayed in real-time
• Subscription Management: Users can manage subscriptions through Stripe Customer Portal
• Refunds: Refund policy is governed by our payment processor's terms

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Is illegal or inappropriate
• Infringes on intellectual property rights

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles. Any legal disputes shall be resolved in the courts of Missouri.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitute acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
